How do we collect your data?
Your data is collected, on the one hand, by you providing it to us. This may, for example, be data that you enter into a contact form. Other data is collected automatically or after your consent when visiting the website by our IT systems. This primarily includes technical data (e.g., internet browser, operating system, or time of the page view). The collection of this data takes place automatically as soon as you enter this website.
What do we use your data for?
Part of the data is collected to ensure the error-free provision of the website. Other data may be used to analyze your user behavior. Insofar as contracts can be concluded or initiated via the website, the transmitted data will also be processed for contract offers, orders, or other business inquiries.
What rights do you have regarding your data?
You have the right at any time to obtain, free of charge, information about the origin, recipient, and purpose of your stored personal data. You also have the right to request the correction or deletion of this data. If you have given consent to data processing, you can withdraw this consent at any time for the future. You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information in the user’s device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent may be withdrawn at any time.
Data Processing Agreement
We have concluded a Data Processing Agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that this provider processes the personal data of our website visitors only according to our instructions and in compliance with the GDPR.
3. General Notes and Mandatory Information
Data Protection
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations as well as this Privacy Policy.
When you use this website, various personal data are collected. Personal data is data with which you can be personally identified. This Privacy Policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.
We point out that data transmission over the internet (e.g., communication by e-mail) may have security gaps. Complete protection of data from access by third parties is not possible.
Notice on the Responsible Party
The responsible party for data processing on this website is:
upflow hire.
Schnabelstr. 14
45134 Essen
Phone: 07181 8850488
E-mail: my@upflowhire.com
The responsible party is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g., names, e-mail addresses, etc.).
Storage Period
Unless a more specific storage period has been specified in this Privacy Policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a justified request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g., retention periods under tax or commercial law); in the latter case, deletion will take place after these reasons cease to apply.
General Notes on the Legal Basis for Data Processing on this Website
Insofar as you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, insofar as special categories of data are processed pursuant to Art. 9(1) GDPR. In the event of express consent to the transfer of personal data to third countries, data processing also takes place on the basis of Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or access to information in your end device (e.g., via device fingerprinting), data processing also takes place on the basis of § 25(1) TDDDG. Consent may be withdrawn at any time. If your data is necessary for the performance of a contract or for pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data if this is required for compliance with a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing may also be based on our legitimate interest pursuant to Art. 6(1)(f) GDPR. The relevant legal bases for each individual case are explained in the following paragraphs of this Privacy Policy.
Notice on Data Transfer to Third Countries Not Safe Under Data Protection Law and Transfer to US Companies Not Certified under the DPF
We use, among other things, tools from companies located in third countries not safe under data protection law as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). If these tools are active, your personal data may be transferred to these countries and processed there. We would like to point out that in countries not safe under data protection law, no level of data protection comparable to that in the EU can be guaranteed.
We point out that the USA, as a safe third country, generally has a level of data protection comparable to that of the EU. Data transfer to the USA is therefore permitted if the recipient has certification under the “EU-US Data Privacy Framework” (DPF) or has appropriate additional safeguards. Information on transfers to third countries, including the data recipients, can be found in this Privacy Policy.
Recipients of Personal Data
In the course of our business activities, we work together with various external parties. In some cases, the transfer of personal data to these external parties is also necessary.
We only pass on personal data to external parties if this is necessary in the context of fulfilling a contract, if we are legally obliged to do so (e.g., transfer of data to tax authorities), if we have a legitimate interest pursuant to Art. 6(1)(f) GDPR in the transfer, or if another legal basis permits the transfer of data. When using processors, we pass on personal data of our customers only on the basis of a valid contract on order processing. In the case of joint processing, a contract on joint processing will be concluded.
Revocation of Your Consent to Data Processing
Many data processing operations are only possible with your express consent. You may revoke consent you have already given at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.
Right to Object to Data Collection in Special Cases as well as to Direct Advertising (Art. 21 GDPR)
IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT, AT ANY TIME, FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION, TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS OR THE PROCESSING SERVES TO ASSERT, EXERCISE, OR DEFEND LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR). IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21(2) GDPR).
Right to Lodge a Complaint with the Competent Supervisory Authority
In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work, or the place of the alleged violation. The right to lodge a complaint is without prejudice to other administrative or judicial remedies.
Right to Data Portability
You have the right to have data which we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.
Access, Rectification, and Deletion
Within the framework of the applicable legal provisions, you have the right at any time to obtain free information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, if applicable, a right to rectification or deletion of this data. For this as well as for further questions on the subject of personal data, you can contact us at any time.
Right to Restriction of Processing
You have the right to request the restriction of the processing of your personal data. For this you can contact us at any time. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
 - If the processing of your personal data was/is unlawful, you may request the restriction of data processing instead of deletion.
 - If we no longer need your personal data, but you require it for the exercise, defense, or assertion of legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
 - If you have lodged an objection pursuant to Art. 21(1) GDPR, a balancing of your and our interests must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.
SSL or TLS Encryption
For security reasons and to protect the transmission of confidential content, such as orders or inquiries you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Objection to Advertising E-mails
The use of contact data published within the scope of the legal imprint obligation for sending unsolicited advertising and information material is hereby objected to. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, for example through spam e-mails.
4. Data Collection on This Website
Cookies
Our internet pages use so-called “cookies.” Cookies are small data packages and do not cause any damage to your end device. They are either stored temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted after the end of your visit. Permanent cookies remain stored on your end device until you delete them yourself or an automatic deletion is carried out by your web browser.
Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g., cookies for handling payment services).
Cookies have various functions. Numerous cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies may be used to analyze user behavior or for advertising purposes.
Cookies that are necessary for carrying out the electronic communication process, for providing certain functions you have requested (e.g., for the shopping cart function), or for optimizing the website (e.g., cookies for measuring web audiences) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified.
The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. Insofar as consent to the storage of cookies and comparable recognition technologies was requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG); consent can be revoked at any time.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for specific cases or in general, and activate the automatic deletion of cookies when closing the browser. Disabling cookies may limit the functionality of this website.
Which cookies and services are used on this website can be found in this privacy policy.
Inquiries by Email, Telephone, or Fax
If you contact us by email, telephone, or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of handling your request. We do not pass on these data without your consent.
The processing of these data takes place on the basis of Art. 6(1)(b) GDPR, provided your inquiry is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this was requested; consent can be revoked at any time.
The data you send us via contact inquiries will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage ceases to apply (e.g., after your request has been fully processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
Comment Function on This Website
For the comment function on this site, in addition to your comment, information about the time the comment was created, your email address, and, if you are not posting anonymously, the username you have chosen, are stored.
Storage of IP Address
Our comment function stores the IP addresses of users who write comments. Since we do not check comments on this website before activation, we need this data in order to be able to take action against the author in the event of legal violations such as insults or propaganda.
Subscribing to Comments
As a user of the site, you can subscribe to comments after registering. You will receive a confirmation email to check whether you are the owner of the specified email address. You can unsubscribe from this function at any time via a link in the information emails. The data entered in connection with subscribing to comments will be deleted in this case; if you have transmitted this data to us for other purposes and elsewhere (e.g., newsletter subscription), however, these data will remain with us.
Storage Period for Comments
Comments and the associated data are stored and remain on this website until the commented content has been completely deleted or the comments have to be deleted for legal reasons (e.g., offensive comments).
Legal Basis
The storage of comments takes place on the basis of your consent (Art. 6(1)(a) GDPR). You can revoke consent you have given at any time. A simple notification by email to us is sufficient for this purpose. The legality of the data processing operations already carried out remains unaffected by the revocation.
5. Social Media
Social Media Elements with Shariff
Elements of social media (e.g., Facebook, Instagram, LinkedIn) are used on this website. You can usually recognize the social media elements by the respective social media logos.
To ensure data protection on this website, we only use these elements together with the so-called “Shariff” solution. This application prevents the social media elements integrated into this website from transferring your personal data to the respective provider when you first enter the site.
Only when you activate the respective social media element by clicking the associated button is a direct connection to the provider’s server established (consent). As soon as you activate the social media element, the respective provider receives the information that you have visited this website with your IP address. If you are simultaneously logged into your respective social media account (e.g., Facebook), the respective provider can assign the visit to this website to your user account. Activating the plugin constitutes consent within the meaning of Art. 6(1)(a) GDPR and § 25(1) TDDDG. You can revoke this consent at any time with effect for the future. The use of the service takes place in order to obtain the legally required consents for the use of certain technologies. The legal basis for this is Art. 6(1)(c) GDPR.
Facebook
Elements of the social network Facebook are integrated on this website. The provider of this service is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. However, according to Facebook, the collected data is also transferred to the USA and other third countries.
An overview of the Facebook social media elements can be found here: https://developers.facebook.com/docs/plugins/?locale=de_DE.
When the social media element is active, a direct connection is established between your device and the Facebook server. In this way, Facebook receives the information that you have visited this website with your IP address. If you click the Facebook “Like button” while logged into your Facebook account, you can link the content of this website to your Facebook profile. This enables Facebook to assign the visit to this website to your user account. We point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or of its use by Facebook. Further information can be found in Facebook’s privacy policy at:
https://de-de.facebook.com/privacy/explanation.
The use of this service takes place on the basis of your consent pursuant to Art. 6 (1) (a) GDPR and §25 (1) TDDDG. Consent may be revoked at any time. Insofar as personal data is collected on our website with the aid of the tool described here and forwarded to Facebook, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, are jointly responsible for this data processing (Art. 26 GDPR). This joint responsibility relates solely to the collection of the data and its transmission to Facebook. The subsequent processing by Facebook after transmission is not part of the joint responsibility. The obligations incumbent upon us jointly have been recorded in an agreement on joint processing. The wording of the agreement can be found at:
https://www.facebook.com/legal/controller_addendum.
According to this agreement, we are responsible for providing data protection information when using the Facebook tool and for the privacy-compliant implementation of the tool on our website. Facebook is responsible for the data security of Facebook products. Data subject rights (e.g., access requests) regarding the data processed by Facebook can be asserted directly with Facebook. If you assert data subject rights with us, we are obliged to forward them to Facebook. Data transmission to the USA is based on the European Commission’s Standard Contractual Clauses.

The company is certified under the “EU–US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA that is intended to ensure compliance with European data protection standards when processing data in the USA. Each company certified under the DPF undertakes to comply with these data protection standards. Further information on this can be obtained from the provider at the following link:
https://www.dataprivacyframework.gov/participant/4452.
Instagram
Functions of the Instagram service are integrated on this website. These functions are provided by Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. When the social media element is active, a direct connection is established between your device and the Instagram server. Instagram thereby receives information about your visit to this website.
If you are logged into your Instagram account, you can link the content of this website to your Instagram profile by clicking the Instagram button. This enables Instagram to assign the visit to this website to your user account. We point out that, as the provider of these pages, we have no knowledge of the content of the transmitted data or its use by Instagram.
The use of this service takes place on the basis of your consent pursuant to Art. 6 (1) (a) GDPR and §25 (1) TDDDG. Consent may be revoked at any time. Insofar as personal data is collected on our website with the aid of the tool described here and forwarded to Facebook or Instagram, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, are jointly responsible for this data processing (Art. 26 GDPR). This joint responsibility relates solely to the collection of the data and its transmission to Facebook or Instagram. The subsequent processing by Facebook or Instagram after transmission is not part of the joint responsibility. The obligations incumbent upon us jointly have been recorded in an agreement on joint processing. The wording of the agreement can be found at:
https://www.facebook.com/legal/controller_addendum.
According to this agreement, we are responsible for providing data protection information when using the Facebook or Instagram tool and for the privacy-compliant implementation of the tool on our website. Facebook is responsible for the data security of the Facebook or Instagram products. Data subject rights (e.g., access requests) regarding the data processed by Facebook or Instagram can be asserted directly with Facebook. If you assert data subject rights with us, we are obliged to forward them to Facebook.
Data transmission to the USA is based on the European Commission’s Standard Contractual Clauses. Details can be found here:

If you would like to receive the newsletter offered on the website, we require an email address from you as well as information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. No further data is collected, or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.
The processing of the data entered in the newsletter registration form takes place exclusively on the basis of your consent (Art. 6 (1) (a) GDPR). You may revoke the consent granted for the storage of the data, the email address, and its use for sending the newsletter at any time, for example via the “Unsubscribe” link in the newsletter. The legality of the data processing already carried out remains unaffected by the revocation.
The data you provide to us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter with us or the newsletter service provider and deleted from the newsletter distribution list after you unsubscribe from the newsletter or after the purpose has ceased. We reserve the right to delete or block email addresses from our newsletter distribution list at our own discretion within the scope of our legitimate interest pursuant to Art. 6 (1) (f) GDPR. Data stored by us for other purposes remains unaffected.
After unsubscribing from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist if this is necessary to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with the legal requirements for sending newsletters (legitimate interest within the meaning of Art. 6 (1) (f) GDPR). Storage in the blacklist is not limited in time. You may object to the storage if your interests outweigh our legitimate interest.
